A US spammer is still bombarding Net users with thousands of junk e-mails a week despite being the subject of an interim court order against him.

Sam Khuri, who runs the Net-based company Benchmark Print Supply, was taken to court by British ISP BiblioTech for sending spam to its users.

In April, BiblioTech rejected an out-of-court settlement from Khuri because he refused to give any assurances that he wouldn't commit the offence again in the future.

Last month, a court in Atlanta decided that Khuri was playing for time by indulging in delaying tactics and ruled in favour of BiblioTech. It also ruled that Khuri had to pay BiblioTech's legal costs of between $8000 and $12,000.

News that Khuri is still sending spam came as no surprise to Manou Marzban, BiblioTech's director of marketing. He said that Khuri would try and delay reaching a settlement for as long as possible.

Khuri has always denied he was a spammer, insisting instead that he uses an opt-in database made up of people who have agreed to receive junk e-mail.

Despite multiple enquiries Khuri has failed to produce evidence that such a database exists. ®
