Apple wins for now: no Galaxy 10.1 in Oz

Injunction granted

Samsung’s Galaxy 10.1 has been blocked in another jurisdiction, with the Federal Court of Australia granting an interim injunction against the sale of the device down under.

In a decision which Samsung had previously warned would devastate its sales in the Christmas period, Justice Annabelle Bennett decided today (October 13) that the interim injunction is “appropriate”.

The number of countries blocking the device is building up, with Apple successfully barring the Galaxy 10.1 in Germany, in a decision which effectively covered the whole of the EU except the Netherlands. Papers have also been filed in Japan, and proceedings continue in the Netherlands and the US.

Samsung will now have to wait even longer to find out if it can get the injunction lifted. A directions hearing is scheduled for October 14.

Samsung had attempted to talk Apple into a deal in negotiations stretching back to 2010, but its offer (the details of which were kept confidential) were rejected. ®
